TRIBUTARIO, ISTANZA DI RIMBORSO RIVOLTA AD UFFICIO INCOMPETENTE

La S.C., innovando rispetto al precedente orientamento, ha affermato che l’ufficio finanziario cui sia presentata una domanda di rimborso è tenuto, ove sia incompetente, a trasmettere la stessa a quello competente, in conformità alle regole di collaborazione tra organi della stessa amministrazione, restando configurabile, in difetto, un silenzio-rifiuto del rimborso medesimo, impugnabile dinanzi alle commissioni tributarie.
