DELITTI CONTRO IL PATRIMONIO, USURA "BANCARIA", D.L. N. 70/2011, CONV. CON L. N. 106/2011, APERTURE DI CREDITO IN C/C, EFFETTO RETROATTIVO FAVOREVOLE PER GLI ISTITUTI DI CREDITO, ESCLUSIONE

Con la decisione in esame la Corte ha affermato che le disposizioni contenute nel d.l. 13 maggio 2011, n. 70 (conv. con modd. in L. 7 luglio 2011, n. 106), meglio noto come “decreto sviluppo”, le quali prevedono una modifica migliorativa per le aperture di credito in c/c a vantaggio degli istituti di credito, non hanno effetto retroattivo ai sensi dell’art. 2, comma terzo, cod. pen. in relazione ai tassi soglia precedentemente previsti, non essendo intervenuta una modifica della norma incriminatrice.
