RESPONSABILITÀ CIVILE, SINISTRO STRADALE CAGIONATO DA FAUNA SELVATICA

In tema di responsabilità extracontrattuale, in fattispecie relativa ad un sinistro stradale verificatosi per l’entrata di un volatile nell’abitacolo di un veicolo in corsa, la S.C. ha escluso la responsabilità della Regione, ex art. 2043 cod. civ., per mancata adozione delle cautele necessarie per la salvaguardia degli utenti delle strade, non essendo stato assolto l’onere probatorio in ordine all’abituale frequentazione, del luogo del sinistro, da parte di animali selvatici ovvero sulla verificazione di incidenti similari, tali da allertare l’autorità preposta ed imporre l’apposizione di cartelli segnaletici.
